OCALA, Fla. — A federal jury
returned a mixed verdict against the actor
Wesley Snipes
on Friday, acquitting him of the most
serious tax charges he faced, but convicting
him on three of six lesser charges. The case
was the most prominent tax prosecution since
the billionaire hotelier
Leona Helmsley
was convicted of tax fraud in 1989.
Mr. Snipes, who has built a
worldwide following acting in films like the
“Blade” vampire trilogy, must pay up to $17
million in back taxes plus penalties and
interest.
He had become an unlikely
public face for the tax denier movement,
whose members maintain that Americans are
not obligated to pay income taxes and that
the government extracts taxes from its
citizens illegally.
The jury found Mr. Snipes
not guilty on two felony charges of fraud
and conspiracy. He was also acquitted on
three misdemeanor charges of failing to file
tax returns or to pay taxes from 2002 to
2004. But the jury found him guilty of
failing to file returns or pay taxes from
1999 through 2001. He faces up to three
years in prison. If convicted of the
felonies, he would have faced up to 16
years.
JJ MacNab, a Maryland
insurance analyst who attended the trial and
is writing a book about tax deniers, said
“the verdict shows that promoters face
serious jail time” but clients who follow
their advice will face a lesser but still
serious risk of imprisonment.
Mr. Snipes’s two
co-defendants — Eddie Ray Kahn, a promoter
of tax denial, and Douglas Rosile, a former
accountant — were convicted on the fraud and
conspiracy charges.
It was the fourth major case
in which the Justice Department failed to
win convictions in cases against prominent
tax deniers. The verdict drew whoops of joy
outside the federal courthouse here from
fellow tax deniers who immediately
proclaimed it another victory that would
draw more people to their cause.
The courts have declared the
tax denier arguments are frivolous. Even Mr.
Snipes’s defense lawyers, who called the
denier claims “dead wrong” in their closing
arguments to the jury, reiterated that
statement after the verdict.
Mr. Snipes will pay all of
his income taxes plus penalties and
interest, said Robert E. Barnes and Robert
G. Bernhoft, who defended him.
“He will make full amends
and pay everything,” Mr. Barnes said.
Mr. Bernhoft said Congress
should repeal criminal tax laws and treat
tax evasion as a civil matter.
Robert E. O’Neill, the
United States attorney here, said current
law “is entirely subjective” on criminal
intent because juries must decide whether a
defendant “sincerely believes” he was not
required to pay taxes.
The Justice Department has
told Congress there is no need to revise the
tax laws on intent. But when Mr. O’Neill was
asked whether the laws should be changed, he
said, “Absolutely.”
The defense, prosecution and
Ms. MacNab all said the verdict showed that
the jury recognized the promoters as
criminals and saw Mr. Snipes as their
victim. They also agreed that the reason the
jury acquitted Mr. Snipes of not filing his
tax returns in 2002 through 2004 was because
he had been told he was the target of a
criminal investigation and jurors believed
that he was exercising his right to remain
silent. The jury convicted him of failing to
file his tax returns before he knew was a
suspect.
Even as Congress has reduced
income tax rates, the tax denier movement
has spread, fueled by high payroll taxes,
political attacks on the
Internal Revenue
Service
and anger among people who have not
benefited from strong overall economic
growth.
Instead of prosecuting all
offenders, the Justice Department brings
cases against well-known individuals, hoping
that widespread news coverage will encourage
compliance, a policy known as general
deterrence. The Snipes prosecution, like the
three earlier cases that resulted in full
acquittals, appears to have backfired.
The Justice Department has
for months declined requests to provide an
official who would discuss its tax
prosecution policies on the record.
Tax deniers assert variously
that the tax laws are valid but do not apply
to them, that no law makes anyone liable for
taxes and that the government tricks people
into paying. Promoters of tax denial claim
that people can legally stop paying income
taxes by executing certain documents, or by
not signing others, like tax returns. Courts
have rejected all these arguments.
Mr. Snipes, 45, was indicted
in October 2006 for filing a false claim for
a $7 million refund (of taxes paid in 1997,
before he stopped paying taxes), and
conspiracy with his two co-defendants to
defraud the government through that claim,
which was not paid.
Since 1986, Mr. Snipes has
appeared in more than 50 films, earning at
least $103 million, court papers showed,
including more than $58 million in the years
covered by the indictment, 1999 through
2004.
Mr. Snipes has built a huge
following, especially overseas, with his
portrayals of intrepid detectives and
fearless vampire slayers and his occasional
comedic roles. In addition to the “Blade”
series, he starred in movies like the action
film “Drop Zone,” the political intrigue
“The Art of War,” and, with
Sean Connery,
the corporate crime thriller “Rising Sun.”
The defense rested on Monday
without calling any witnesses. Mr. Snipes
declined to answer questions outside the
courthouse on Friday, where a gaggle of
reporters was surrounded by dozens of fans
from this central Florida city.
In closing arguments on
Tuesday, lawyers for Mr. Snipes sought to
portray him as a well-intended victim of bad
advice by his co-defendants. They called his
tax theories “kooky” and “crazy,” but said
acting on these views did not make him a
criminal because he disclosed his actions.
The Supreme Court has ruled
that tax deniers can demonstrate the absence
of criminal intent by asserting that they
“sincerely believe” that they are not
required to pay taxes, although they cannot
escape the levies. (NOTE: Complete BS, read
the IRS Code on who can be levied!)
Prosecutors argued that Mr.
Snipes showed criminal intent when he sent
the government three bogus checks to pay $14
million in taxes and an amended tax return
that was subtly altered with software to
insert the word “no” before “penalty of
perjury.”
Defense lawyers said Mr.
Snipes did not file tax returns after his
indictment because the I.R.S., by making him
the target of a criminal investigation,
“forced” him to exercise his right to remain
silent.
After his indictment,
however, Mr. Snipes sent the government a
series of rambling letters describing his
tax theories and warning that “pursuit of
such a high-profile target will open the
door to your increased collateral risk.”
Mr. O’Neill, the lead
prosecutor, called the filings “gibberish”
whose purpose was to thwart law enforcement.
In one 600-page document,
Mr. Snipes said he was legally a
“nontaxpayer” and the tax laws did not apply
to him because he was not a resident of the
District of Columbia, was not a federal
official and was not engaged in any trade or
business, all common tax denier arguments.
Mr. Snipes also complained
that the I.R.S. violated his 14th Amendment
rights to equal protection because it would
not help him establish what he said was his
rightful status as a legal nontaxpayer.
Mr. Snipes joined the tax
denier movement after becoming upset when
told that his 1999 income tax would be more
than $2 million, Carmen Baker, his former
assistant, testified.
A mutual acquaintance
introduced Mr. Snipes to one of his
co-defendants, Mr. Kahn. Mr. Kahn operated a
Christian ministry, the Guiding Light of God
Ministries, and a central Florida company
called the American Rights Litigators that
helped tax deniers avoid paying.
Mr. Kahn, who was imprisoned
for tax crimes in 1985 to 1987, fled to
Panama after the 2006 indictment. He was
extradited to stand trial on the latest
charges but refused to attend the
proceedings, remaining in his jail cell,
after telling Judge William T. Hodges that
the court had no authority over him.
Mr. Snipes and Mr. Rosile
are free on bail.

According to the Associated Press, "Republican presidential hopeful
Ron Paul's supporters
raised over $6 million Sunday to boost the 10-term congressman's campaign for the White House."
The AP report also said, "The [Paul] campaign's previous fundraiser brought in $4.2 million."
According to the Paul campaign website, "In a 24-hour period on December 16, the campaign raised $6.026 million dollars, surpassing the one-day record of $5.7 million held by
John Kerry.
"During the day, over 58,000 people contributed to Dr. Paul's campaign, including 24,940 first-time donors. Over 118,000 Americans have donated to the campaign in the fourth quarter.
"The $6 million one-day total means the campaign has raised over $18 million this quarter, far exceeding its goal of $12 million."
Now, if one listens to most of the political pundits in the major media,
Ron Paul is some
kind of "kook," and his supporters are also a bunch of "kooks." So, the question must be asked, Just who are these kooks that are supporting him, and why are they giving
Ron Paul all this
money?
First, let's take a look at this "kook" who is receiving all this money.
Ron Paul was born
the third son of Howard and Margaret Paul, and was brought up with a work ethic in which one worked six days a week and went to church on Sunday. His first job was at age 5 helping his uncle wash bottles. He worked all the way through his youth mowing lawns, delivering newspapers, working in a drug store, delivering furniture and laundry, etc.
In high school, Ron was a track star, winning state as a junior in the 220-yard dash and running 2nd in the 440. His time in the 100-yard dash was 9.8. That's pretty good. I was never able to break 10-flat in the 100. Although, I bet I could have beaten him in the 50-yard dash. He also wrestled in high school. Coincidentally, so did I. But here Ron leaves me: he was president of the student council and an honor student. I never accomplished that. I was just glad to get promoted to the next grade. Even as a senior statesman,
Ron Paul keeps himself in terrific shape. Have you seen him lately? He still maintains a rigorous exercise regimen.
Ron's two brothers are both ministers, and he became a medical doctor. He graduated from Duke University School of Medicine. When the Cuban Missile Crisis arose, Ron became a flight surgeon in the
U.S. Air Force. He also served in the Air
National Guard.
As an OB/GYN physician, Dr. Paul has delivered more than 4,000 babies, and he and his wife, Carol, have been married for more than 50 years. They have 5 children, 18 grandchildren and 1 great-grandchild.
Ron Paul is currently in his 10th term as a congressman from
Texas.
As a
congressman, Ron Paul
has never taken a government-paid junket. He is not accepting a government pension. He returns a portion of his office budget every year to the taxpayers. As a member of Congress, he has never voted a raise for himself. Do you know any other member of Congress that can make such a claim? Of course you don't, because
Ron Paul is truly one-of-a-kind.

Ron Paul has received more campaign contributions from active-duty military personnel than any other Presidential candidate from either party.
But who are the other "kooks" supporting
Ron Paul? What kind of
people give more than $18 million in a quarter-year to a Presidential candidate that is almost universally ignored by the mainstream press? What kind of people give record contributions to a Presidential candidate that is lampooned by his fellow Republican Presidential contenders?
For example, Mike Huckabee
recently said he could support any of the other Republican Presidential contenders (including
Rudy Giuliani), except
Ron Paul. That
means, Mike Huckabee would
rather support pro-abortion, pro-gay marriage, pro-gun control liberal such as Giuliani than support the pro-life, pro-traditional marriage, pro-Second Amendment candidacy of
Ron Paul. Why is that?
Furthermore, why are the entire major media and establishment Republican machine either ignoring or lampooning a distinguished Air Force veteran, medical doctor, and ten-term Congressman? What is it about
Ron Paul that the
elite are so afraid of?
Here is something else: while
Ron
Paul's contributions have exploded,
Mike Huckabee is all but
broke! How can that be? How can a political "front-runner" be out of money, while a man who "doesn't have a chance" is breaking fundraising records?
So, who are these "kooks" who are sending
Ron Paul so much money?
And just why are they sending him so much money? I will tell you who they are, because I am one of them. They are rank-and-file, tax-paying citizens who are sick and tired of out-of-control federal spending and deficits. They have had it with an arrogant federal government that runs roughshod over both the Constitution and the liberties of the American people. They are people who have had enough of the IRS, the BATFE, and a thousand other federal agencies that have "erected a multitude of New Offices, and sent hither swarms of Officers to harass our people, and eat out their substance." (Declaration of Independence)
They are people who see through the phony, disingenuous federal politicians who only want to fleece the American citizenry for the purpose of building their own personal fortunes. They have had it with the Military-Industrial complex that desires to build international empires at the expense of the blood and sacrifice of the American people. They have had it with
David Rockefeller and his Council on Foreign Relations. They have had it with the arrogance of
George W. Bush and
Nancy Pelosi.
They are sick and tired of paying outlandish taxes for a public education system that produces high school graduates who cannot read and write. They are sick and tired of working for 30 years to pay off a mortgage, only then to be forced to pay extortion money (a.k.a. property taxes) for the rest of their lives to the feudal state. They are sick and tired of the government telling them what they can and cannot do with their own property. They are sick and tired of watching people with food stamps buy T-bone steaks and expensive
Nike tennis shoes while they are forced to buy fatty hamburger and
cheap sneakers.
They are sick and tired of watching their manufacturing jobs go to
China and
India. They have had it
with money-hungry businessmen who hire illegal Mexicans at slave labor wages. They have had it with labor unions promoting politicians who support
NAFTA, CAFTA, and the FTAA. They are sick and tired of being bled dry at the gas pump.
They have had it with this phony "war on terrorism" that sends trillions of dollars to nations throughout the
Middle East, but refuses to close our own borders to illegal immigration. They have had it with the "war on drugs" and the "war on terror" being used as excuses to trample people's freedoms. They have it with
Vicente Fox
and Felipe Calderon. They have had it with Bush's North American Union. They have had it with
Joel
Osteen and Rick Warren.
In short, they have just had it!
They also know that a vote for any other Presidential candidate is a vote for more of the same. Democrat or Republican: it is more of the same.
Ron Paul, and
Ron Paul alone, will bring
a revolution of freedom and independence to America. Believe me, the
Ron Paul revolution is bigger than
Ron Paul. This
is the beginning of a movement.
No matter what ultimately happens to
Ron Paul's candidacy, the
fight to return America to its roots of freedom and independence has started. The fire is lit. There is no putting it out. There will be other Ron Pauls, other campaigns, other spokesmen, other fundraising. The people supporting
Ron Paul
will not be silenced; they will not be ignored; they will not be intimidated. In truth,
Ron Paul's campaign may just be the beginning of the end of the elitist, globalist, stranglehold over America.
As one who is also fed up with the globalist goons that dominate the two major parties, I join the
Ron
Paul revolution and vow to fight for the rest of my life for the freedom and independence of these United States. This means I will never again support a business-as-usual, millionaires-club, globalist toady from either party ever again! I will only support candidates who are fully committed to restoring constitutional government. If that makes me a kook, so be it.

AUSTIN, Texas -
Ron Paul may be the political butterfly of the
2008 presidential campaign. An obscure congressman from
Southeast Texas for most of his political career, Paul
has metamorphosed into the favorite of those looking for
a candidate outside the political mainstream.
Legions of die-hard
fans formed across the country after Republican
candidate debates and Internet blogs exposed his
contrarian views.
Paul, 71, remains
one of the longest of long shots for the GOP nomination,
but that hasn't deterred supporters from making cold
calls to voters in early contest states, plastering the
Internet with plaudits, and loudly challenging Paul's
White House rivals at campaign stops.
"I honestly believe
that
Congressman Ron Paul, as crazy as it might sound,
I believe he is the father of the modern Republican
Party," said Jason Stoddard, 31, an
Austin, Texas, entrepreneur who has no formal
ties to Paul's campaign but has made more than a
thousand calls to Iowa voters urging their support.
The enthusiasm of
admirers like Stoddard has boosted Paul's national
profile and helped his campaign raise $3 million over
the past three months — a fraction of the double-digit
millions chalked up by the top-tier candidates, but a
respectable sum for an underdog.
That enthusiasm,
however, hasn't translated into widespread support in
presidential polls for Paul, who was a Libertarian Party
candidate for president two decades ago and is best
known as a champion of small government, low taxes and
minimal foreign intervention.
National opinion
polls of Republican primary voters generally show his
support at about 2 percent. And while he's accumulated a
cache of campaign dollars, Paul's not spending most of
it. He has spent just $650,000 this year, the
third-least of all 2008 presidential candidates,
according to federal campaign finance reports.
"Most of the oxygen
is being taken up, especially on the Republican side, by
those who look like they might have a prayer of winning
in a Democratic year," said
University of Texas political scientist Bruce
Buchanan.
An
obstetrician-gynecologist and former Air Force flight
surgeon, Paul stands out from the other Republican
candidates on several scores, including his long-held
opposition to the Iraq war. As a result, he might
benefit from
President Bush's near-record unpopularity and the
growing public discontent with the war, said Michael
Tanner, a policy analyst at the libertarian Cato
Institute in Washington.
But potential
supporters may find some of the 10-term congressman's
other views more difficult to accept, including calls
for a return to the gold standard and a radically
smaller government with no Education Department, Energy
Department or
Internal Revenue Service.
Paul also is just
as likely to turn off as many voters as he turns on with
positions that straddle both liberal and conservative
camps. He opposes the death penalty and votes against
military appropriations. He also opposes abortion and
gun control. He's known on Capitol Hill as "Dr.
No."
Paul spokesman
Jesse Benton acknowledged that Paul has formidable
challenges to overcome before the first votes for the
nomination are cast in about five months. The campaign
just bought its first radio ads in
Iowa and
New Hampshire and has nearly tripled its staff to
25 in the past month.
"We realize the
odds are still pretty long for Dr. Paul, but we think
that Ron is a real legitimate player now that people are
starting to pay attention," Benton said.
As comedian
Stephen Colbert put it when Paul appeared in June
on his mock right-wing talk show, "You are an enigma
wrapped in a riddle nestled in a sesame seed bun of
mystery."
